  • Disability Discrimination Lawsuit Filed Against Vitas Healthcare Corp.

    Miami - The EEOC has filed a lawsuit today against Vitas Healthcare Corporation, alleging that the health care company refused to reasonably accommodate an employee who had hypertension. According to the lawsuit, an employee asked to be reassigned to a vacant hospice nurse position which did not require extensive driving. The extensive driving she was doing at her current position was exacerbating the employee’s hypertension. The employee was required to compete for the position and she was unsuccessful in obtaining it. The EEOC is seeking back pay and compensatory and punitive damages for the employee.

    West Palm Beach - Callaro’s Prime Steak & Seafood, LLC will pay $10,000 and furnish significant injunctive relief to settle a disability discrimination lawsuit filed by the EEOC. The EEOC’s lawsuit alleged that Callaro’s violated the Americans with Disabilities Act (ADA) when the company forced an employee to resign because she was associated with an HIV-positive family member and subsequently regarded her as disabled. The EEOC alleged that after Callaro’s learned the employee’s family member was HIV-positive, the company insisted that she get tested for HIV.
